CarrierHero Terms of Service

By using CarrierHero you agree to these Terms. If you are using CarrierHero on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
1. The service
CarrierHero provides temporary, consent-based phone tracking for third-party carrier loads. A dispatcher creates a tracking request, the driver consents to load-scoped location sharing, the customer sees a text-only status page, and we optionally write a status note to your Samsara route. CarrierHero is not a transportation management system, dispatching system, or vehicle telematics system.
2. Eligibility and accounts
You must be at least 18 years old and authorized to use a fleet/logistics SaaS for your organization. You are responsible for activity on your account and for keeping your credentials confidential. You agree to use CarrierHero only for active delivery operations and not to track persons without their informed consent.
3. Driver consent
Dispatchers may send tracking requests only to drivers who have a current business relationship with the dispatcher's organization for the specific load being tracked. The driver must affirmatively start tracking. CarrierHero does not enable covert tracking and may suspend any account that uses CarrierHero to track persons without consent.
4. Acceptable use
You agree not to:
- Use CarrierHero to track any person other than a driver operating a specific load with their consent.
- Send SMS or other messages through CarrierHero to anyone who has opted out, or to numbers obtained without permission.
- Reverse engineer, decompile, or attempt to circumvent CarrierHero security or rate-limit controls.
- Use the service to violate any law or any third-party right, or to harass, stalk, or harm any person.
- Resell or sublicense CarrierHero without our written consent.
5. Samsara integration
If you install CarrierHero on a Samsara organization, you grant CarrierHero permission to read fleet routes and write to the notes field of fleet routes under that Samsara organization. CarrierHero does not modify actual arrival times, stop states, route progress, vehicle telematics, or driver records on Samsara. Your use of Samsara remains subject to your agreement with Samsara.
6. Pricing and billing
- Installing CarrierHero from the Samsara Marketplace is free.
- The native mobile driver app is free on iOS and Android.
- The CarrierHero web dispatcher costs USD 10 per organization per month. A 14-day free trial is offered without requiring a payment method.
- Subscriptions auto-renew unless cancelled. You can cancel through the billing portal at any time and retain access through the end of the paid period.
- Pricing is exclusive of taxes. We will charge applicable taxes where required.
7. SMS
SMS messages sent through CarrierHero are subject to U.S. A2P 10DLC and Canadian CASL rules. Drivers can reply STOP at any time to opt out and START to opt back in. Standard message and data rates may apply.
8. Customer data and privacy
Our handling of personal information is described in the Privacy Policy, which is incorporated by reference.
9. Service level and availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance where practical. We are not liable for any third-party outage (Samsara, Twilio, Stripe, or hosting providers) outside our control.
10. Termination
You may stop using CarrierHero at any time and uninstall the Samsara app to revoke our access. We may suspend or terminate accounts that violate these Terms. Sections 4, 6, 11, 12, 13, and 14 survive termination.
11. Disclaimers
CarrierHero is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim, to the maximum extent permitted by law, all warranties express or implied, including merchantability, fitness for a particular purpose, and non-infringement. CarrierHero does not guarantee delivery, arrival times, or any operational outcome.
12. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or related to CarrierHero will not exceed the greater of (a) the amount you paid us in the 12 months prior to the event giving rise to the claim, or (b) USD 100. We are not liable for indirect, consequential, special, incidental, punitive, or exemplary damages, including lost profits or lost data, even if advised of the possibility.
13. Indemnification
You agree to defend and indemnify CarrierHero against any claim arising from your use of the service in violation of these Terms, including claims that you tracked a person without consent, sent SMS in violation of applicable law, or violated any third-party right.
14. Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, and applicable federal laws of Canada, without regard to conflict-of-laws principles. Disputes will be resolved exclusively in the courts located in Toronto, Ontario, except where prohibited by mandatory consumer protection laws of your jurisdiction.
15. Changes
We may update these Terms from time to time. Material changes will be announced at least 14 days before they take effect. Continued use of CarrierHero constitutes acceptance.
